My neighbor cut down a 40-year-old Japanese Maple while I was away.
Location: Colorado, USA.Just got back to my place near Fort Collins after a week on the road and I am losing my mind. My neighbor took it upon himself to hire a "landscaping" crew (probably just some guys with a chainsaw) to remove a mature Japanese Maple that was fully on my property. His excuse? He said the needles and leaves were messing with his "mountain view" and "fire mitigation" efforts. The tree was roughly 40 years old and was the centerpiece of my yard. I called an arborist immediately. He told me that since this is Colorado and the tree was that established and healthy, the replacement value is astronomical. He is drafting a formal appraisal but hinted that we are looking at 20k to 25k easy just for the tree, let alone the logistics of getting a crane into my backyard. I know Colorado has statutes regarding timber trespass. My lawyer already mentioned treble damages because the guy admitted he did it on purpose while I wasnt home to stop him. The neighbor had the gall to offer me a couple hundred bucks for "the inconvenience" and told me to just buy a couple of saplings at a local nursery . I refused to take his money and told him to wait for the process server. Has anyone dealt with treble damages in CO specifically for ornamental trees ? This guy basically nuked my property value for his porch view and I am not planning on letting this go . Mature maple tree cut down by neighbor
NOTE: this has been reposted due to address present in the Google photo that I needed to remove. Her house is the beach house, not the blue house. There is a survey present, and there are two fences, a privacy fence and a chain-link fence, which was removed to cut down the tree. The dotted red line shows the survey line, the tree trunk was more than 60% on my friend’s property. The neighbor previously asked to cut down the tree and was denied. My good friend is currently traveling in Europe and while she is gone, her next-door neighbor (who had already asked about and been told no regarding cutting down this tree ) cut down the shared tree. Apologies for changes between my/her as I am posting on her behalf. From my friend: “As far as I am aware, Illinois (Chicago specifically) law says he cannot cut that tree down without my consent and he obviously did not have my permission or consent. I want to sue him, his shit architect and the contractor who should know what a surveyed property line is. I've had my property surveyed and the chain link fence indicated in red shows that the tree is more than half on my property. My house is on the right. I wanted to get a Google maps picture to prove what the tree was in case it updates. My favorite place that ive enjoyed for 22 years.... now a hot baking environment, all my plants chosen for the shady conditions over decades.... all fucked. I am devastated and furious. (Catsitter) had to force them to stop grinding the stump because two of my cats are buried at the base of that tree.” From what I have followed on /treelaw, I believe that the next step would be to have a certified arborist come out and give a value statement? If that’s the right term to determine what she is owed once this goes through. Would this be a small claims issue or… Not sure where to start after the arborist. The Maple and Orange Trees are Thriving!
Alright, this is my final update on the matter, since you guys wanted to see the finished results. It is fall and the Orange Tree is finally all grown up. I got my tap working on the Maple Tree and is providing Syrup! I guess the oranges won't appear until next summer which is a bummer. But I am patient. Maple vs Orange Tree Situation
I just had to leave an update on the previous post of mine. Thanks everyone for the amazing laughs, memes and tips as to what to do with the trees! I felt embarrased at first but this is the first time i've interacted with this community and you guys have been amazing! 🤣🥰 The rock is finally removed from the orange tree and it has space to grow. I was adviced that i didn't need to water it and that i should not dig around it. Hopefully it will become a full orange tree soon! 🫡 I was thinking of cutting down the maple tree but you guys wanted me keep it and tap it. So i'm giving it the same care and attention i always did 🤣. Hopefully i can get a recipe for a tapper pretty soon but i haven't gotten that far yet.🤔 Thanks for the amazing laughs i had at work today. What is your favorite Maple tree?
I am planning landscaping around the home that we are building on our 30 acre farm in North Carolina (zone 7, hot summers, humid). My plan around the house is mainly evergreens and conifers for year round color and texture. I would love a big Maple to the side of the house but I’m not sure what varieties are best for long term growth. Neighbor put in a new fence and cut down two of my trees as well as ripped out the plants surrounding it in the process. One was a 15-17 ft dogwood, the other was a 4ft dwarf Japanese maple. How to proceed? Surveyor confirmed it was my land. Several hydrangeas and hostas gone too. Livid.

What to do with this Japanese Maple against the house?
I bought this house a couple of years ago and it has this beautiful Japanese Maple tree which unfortunately has overgrown it's space. I've only trimmed a little bit in fear of accidentally taking too much off, but it still pokes out over the sidewalk and hits the house. I'm also somewhat worried about the roots damaging the foundation of the garage which is less than 2 feet away.
