John KehoeEconomics editor Apr 10, 2026 – 5.36pm A potential government move to restrict negative gearing to one or two properties per landlord would create a red tape nightmare for the Tax Office, increase compliance costs for taxpayers and risk exploitation by wealthy investors, former Treasury and Australian Taxation Office officials have warned. Treasury is examining a range of potential tax changes for the government in the lead-up to the May 12 budget, including curtailing the 50 per cent discount on capital gains, restricting negative gearing and introducing a minimum tax rate on trust distributions of about 25 or 30 per cent. The government is considering changes to negative gearing as part of wider tax reforms. Steven Siewert Treasurer Jim Chalmers has put intergenerational equity at the heart of any tax changes, particularly making it easier for younger people to buy homes. While reducing the 50 per cent capital gains discount to about 30 per cent is considered the government’s favoured option, Treasury is also canvassing limits on negative gearing. Options include restricting the tax deduction to new-build homes to encourage additional housing supply, capping the proportion of net rental losses that can be deducted, and limiting negative gearing to one or two investment properties per taxpayer, according to two sources familiar with the discussions who spoke on the condition of anonymity. Advertisement Negative gearing is where investors can reduce their income tax bill by offsetting losses from investments against wages, typically where the cost of mortgage interest and property repairs is more than rental income. While capping the number of negatively geared homes is considered politically attractive, former Treasury and ATO officials are alarmed about the unintended consequences and say it would not ease housing affordability. Cash-flow problems Geoff Francis, a former senior Treasury tax official, said the limit could cause havoc when interest rates rose, as several properties in an investment portfolio shifted from being positively geared to negatively geared. It could also cause cash-flow problems for investors when a tenant moved out and a rental property became vacant, and when spending on repairs was undertaken. “The whole idea seems to be driven by some populist notion where landlords are the bad guys exploiting renters and thwarting home ownership, but the government may pretend it is being pragmatic by allowing people to have a modest amount of aspiration through one or two negatively geared properties but no more,” Francis said. Such a move would also be inequitable as a wealthy investor could negatively gear one or two $2 million houses, but a person who negatively geared more than one or two $500,000 apartments would be penalised, he said. Francis, who also worked at the ATO, said policing and complying with the limits would be a massive burden. “Rental income would need to be identified by property and differentiated from other income and interest payments would also need to be identified against particular properties. “There would be plenty of taxpayers that had a mixture of property, shares and debt within the one portfolio, which would need to be unpicked somehow. “Wage and salary income, dividends and bank interest are all easy enough to trace, but other income from leases, rentals, professional payments, are normally just categorised as other income.” The Organisation for Economic Co-operation and Development, in a new competitiveness report on Thursday, urged Australia to be bolder on tax reform by increasing the 10 per cent GST, to help reduce the high reliance on personal and corporate income taxes. “Stronger reliance on goods and services taxes, a more growth-friendly and resilient tax base, can help rebalance the sharing of the tax burden between people in employment and the retired population in the context of an ageing population,” the OECD said. “Such taxes are also more difficult to evade and have weaker disincentives to work than income taxes.” Treasurer Jim Chalmers has put intergenerational equity at the heart of any tax changes, particularly making it easier for younger people to buy homes. Getty The OECD said Australia would benefit from reducing tax concessions on capital gains on housing and superannuation. It also suggested the political no-go idea of a levy on the tax-free principal place of residence. Tax adviser David Montani, author of the book Tax Wars, agreed with the OECD that increasing the GST would enable the government to slash income taxes, while opening up bigger reform opportunities to negative gearing and capital gains. Limiting property tax breaks to new build homes would encourage the supply of extra housing, he said. About 90 per cent of property investors currently buy established homes. ATO data shows 72 per cent of 2.2 million landlords own only one investment property. Some 19 per cent of landlords own two, only 6 per cent own three, 2 per cent own four, 1 per cent own five and less than 1 per cent own six or more. “So if you limit it to one or two properties, it would have no impact,” Montani said. ”To me, that’s creating the appearance of doing something, but would actually do little to redress the issue.“ A former senior ATO official, who requested anonymity to speak more freely, said capping the number of properties was a “crazy idea” that had not been previously seriously considered by Treasury and the ATO. “Well-off people could get a lot more out of it by buying more expensive properties,” he said. It would create problems for ATO administration and taxpayer compliance for jointly owned properties by two or more people, the buying and selling of properties, inherited properties, marriage separations, restructuring property portfolios and bridging finance for purchases, he said. Well-off people could also get around the limit by using companies and trusts, he said. “It would be so easy to figure out a way to get around this, and trying to keep track of these things would be a nightmare. “Compliance costs would go through the roof and the accountants would make money hand over fist, which costs the taxpayer.” Henry’s recommendation ‘far better’ Paul Tilley, author of Mixed Fortunes: A History of Tax Reform in Australia, flagged the problem of the asymmetry between allowing full deductions for expenses such as interest and home repairs, while only taxing half the capital gain when an asset was sold. Rather than an arbitrary cap on the number of homes, Tilley endorsed a recommendation from former Treasury secretary Ken Henry’s 2009 tax review as far better. Henry proposed a 40 per cent discount on capital gains and other investment income, such as bank interest, matched by a 40 per cent discount on deductions for investments. This means investors could only claim 60 per cent of any investment expenses. “You’re better to fix the problem at the source, rather than capping the number of properties,” Tilley said. But ultimately, it chose a simpler option of halving the CGT discount to 25 per cent and limiting negative gearing to new-build homes, while shielding existing investors from the proposed changes. Another former Treasury tax official who supports winding back the CGT concession and negative gearing said capping the number of homes was a “terrible idea”. “Albo would love to go out and sell that nobody can negatively gear more than two properties because most people who don’t understand it would back it in. “But you’d at least hope Treasury and Chalmers would be fighting for the policy-sound approach.” Former Treasury tax policy official Peter Greagg said quarantining investment income losses to offset against only future gains from the same asset, not against wages, like some European countries and the United States would be a better approach. “But you don’t want to tax capital income as high as labour income because it’s already been taxed once as wages and we want to attract capital investment,” Greagg said. I seriously can't understand how anyone who has tried working from home could willingly go back to commuting and the hassle of transportation. I mean, I just made a cup of coffee exactly how I like it, cleared my inbox while sitting in my shorts, and walked my dog during my lunch break. I've already gotten more work done today than I used to get done by noon at the office, with all that noise and eye-straining lighting. And the thing that's driving me crazy is that my productivity has gotten so much better. I sleep an extra hour every day, eat clean home cooked food, and my commute is exactly 15 seconds long. The only problem is that my dog thinks my Zoom calls are his cue to start barking at anything that moves. Look, I know it's not all rosy. The back to back video calls can be draining, and honestly, sometimes I have to remind myself how to have a normal conversation with human beings and not just my dog. But for me, it's 99% worth it. My wife and I both work from home and she had been using this "flex" area as an office for a number of years. We just had the two large open sides glassed off with fixed panes, along with a large sliding glass door. There is a 55" x 24" pass through window on one end of the office (on the other side is the bench in the 3rd picture and the home's front door) that we are hoping you can help us out with. We felt like glassing it may have been too much glass, and it's the first thing people see when they walk in the door. Hi sewing friends! My partner and I bought our own (small) home this year and we both work from home. His office is in a little nook (originally a breakfast nook) off our kitchen, so he needed some visual separation from me when I’m cooking/making coffee and he’s in the zone. I settled on wanting Japanese Noren curtains (two flat rectangle panels, and not all the way to the floor) to let light in and let our dog walk under the curtain :) After exploring ideas on Etsy and Youtube for a while, I wanted to try my hand at the Korean Pojagi technique—a reversible patchwork quilting technique that reminds me so much of stained glass. There’s no pattern to it, though I supposed you could use one—you just starting sewing pieces of fabric together, then sewing larger chunks together, then repeat til you have the size you want and then you finish the edges. It took a lot of trial and error when laying out the big chunks to decide how exactly I wanted them laid out in the curtain. Pojagi essentially uses flat felled seams to connect the fabric pieces, then I used a folded hem to finish the edges. I also sewed a curtain rod pocket at the top to hang them from a rod. The colored linen squares were already in my stash—I had ordered linen color samples for a project years ago and hung on to all of them in case I ever had a use for 2x2” squares of linen, lol. I recently had to return to the office 3 days a week for “collaboration” even though the rest of my team works in another state. I want to make the office unpleasant to be in for a while so I can WFH more often. The office houses about 200 people when it’s fully occupied. It has high ceilings, so no access to heating vents. On phone. Sorry for typo and grammar. This was maybe 6-7 years ago. I was the only full time IT person at a $100+ million/year in sales company. I worked 55-65 hours a week between on site and at home, this is important to remember. I reported to the controller and everything was fine until he quit and they hired the new guy. The new guy was the youngest controller ever hired by our site or any of our sister sites and man did he think he had something to prove. First thing he does is pull me into his office and inform me that, “My team will he the first ones in the building and the last ones to go home. I expect to see you in your office any time I am in this building. I don’t care what you do. Just make sure you are here 730 am to 6 pm.” I tried to argue why that was a bad idea. He was having none of it. My response is a collapsed “Okay”, as if I tried to make it a single syllable. Anyone that worked with me knew they were now fucked. I was literally the only guy with the keys to the castle. Literally untouchable. Malicious compliance: Met with the OSHA lead to see what appliances I could run in my office safely (no electric kettle 😢 ). Met with HR and informed them I would be making a spreadsheet of my daily work activities just incase I needed to prove my productivity for any reason in the near future. They thought it was a joke and said ok. Then I set up my second home. Over the course of the next few months every day I showed up to work at 715. Went to my office. And worked until 3:30. Then I would start my vacation. I brought in a raspberry pi and played games, brought in crock pots of food and invited key members in to graze and chit chat, one dat I set up a panini press bar and invited all the engineers in for sandwiches, watched movies, listened to music and e-books, tried to get a dart board approved by the safety lead (said no before I could finish my request). Basically I did all the things I did at home, at the office. People would stop in after 3:30pm and ask for help and I would tell them no. Explain what I was told and tell them to stop in at 730 tomorrow which was a mute point because the site was a 830-430 place and if possible immediately go back to slacking off while they were standing there asking for help. This lasted about 2 months. Then HR called me and we had THAT meeting. I explained everything. Showed my spreadsheet of work and I included all the times I spent doing 0 work and what I was doing to slack off in that time. I was averaging around 35 hours of work a week. Between breaks and lunches that is normal. They were mad at me and even more mad at the controller because they knew my productivity tanked and as a by product so did multiple departments. I was told to go back to doing what I was doing before he started and I would start reporting to one of the departments that needed me the most instead of finance. Everyone in the office pieced together that their life got harder for those few months because the new guy deemed it so. He ended up relocating shortly after because no one wanted to work with him. MeToo destroyed the company and Upside was sold off to venerable STX. If that wasn't enough the press tour has been hell for both stars. Hart notably gained and then very quick lost the job of Oscar host due to old homophobic jokes while Cranston has faced criticism for playing a quadriplegic person and then going around showing off his fancy working legs like a real rich boy. The Upside - So where is the...good news? Well the box office isn't a stellar opening for the $37.5M budgeted film which has had an extensive marketing push. But it did dethrone the Aquatic Man himself and more importantly carries an A rating on Cinemascore. And let's face it, poor critics reviews aren't really a factor in a film like this that's going more for overall charm and general audience appeal. This is coming at a pretty good time for audiences who may want to just watch a relaxing adult dramedy and it could subvert all the tainted crap that came with its release. It's a matter of time and especially how it does next weekend, but with Glass tracking lower than previously expected (reasoning: crummy reviews) and no other major competition it could stick around in the rather dull month. Aquaman - My Billion Dollar Man! The swexy™ (that's wet and sexy) boy just crossed a milestone for a DCEU film, becoming the first one ever to cross $1B worldwide. That also makes it the only DC film to pass $1B worldwide that does not star The Batting Man. In fact it's now grossed more than The Dark Knight and is just $65M less than The Dark Knight Rises, which it could easily pass to become the highest grossing DC film ever worldwide. With a budget of $18M that is not a huge hurdle to overcome but as a big family pitched release in January it's not going to necessarily break the...dog...bank either. The explanation for the underperformance could just be an overabundance of these kind of dog movies or the very spoilery trailer which basically showed the entire plot. Whatever the reasoning the film did connect with the audiences who did see it where it scored an A- on Cinemascore, so likely this will hold long enough just to make a profit. On the Basis of Sex - It was a good week for Old Ruth Bader G., as she was declared cancer free, her documentary was shortlisted for the Oscars, and a biopic about her landmark sexual discrimination case On the Basis of Sex jumped up to 1,923 theaters to come in at #8 with $6.2M. Certainly the news of RGB's healthy diagnosis was welcome news to many but also great accidental marketing for the film which has had very good expansions through the Oscar season, despite itself not having much of an Oscar stronghold. The film's one potential win for Best Actress has now been swallowed up by the locust swarm that is Glenn Close who has emerged from her lack of win for her incredible run in the 1980s to demolish all in her wake with tears and great speeches. So this box office victory is one almost solely for RGB herself. And as political tensions only seem to get spicier expect this one to have a good run, especially with an A rating on Cinemascore. Of course once more people know about the secret end of the film, where she brings a landmark civil rights case against Thanos which leads into the plot of Avengers: Endgame, expect it to become the first film in 2019 to cross $1B. Replicas - Did you know there was a sci-fi movie starring Keanu Reeves that came out this week called Replicas? Wait, you guys are /r/movies users, of course you knew that. Well in the real world, normal people did not as the film bombed horrifically, opening at #12 with $2.5M. That makes it the 28th worst debut ever for a film opening in over 2,000 theaters and the worst wide release opening ever for Reeves. The film about Reeves trying his hardest to act with a goofy visor on his head had a budget of $30M so don't expect this to recoup any money unless it becomes the biggest film ever in Romania or whatever. And don't expect cult status either as when reviews finally came out (as it wan't screened for critics) it got a terrible 10% on RT and a C on Cinemascore. It's not a great moment for the studio, the brilliantly named Entertainment Studios, who have now made 4 films in a row that debuted less than $6M in wide release. Well at least one thing will be entertaining, their bankruptcy hearings! Oscar Movie Round-Up - Well it's the weekend after the Golden Globes so let's first see how the big winners from that night are doing, especially after a week of controversy for both. Bohemian Rhapsody not only received its fair share of anger for its win but also notably allowed legendary not good dude Bryan Singer to take credit for the win despite getting fired from the film early on. Classy. However that made little waves in the box office as the film had another great week where it added 254 theaters and made $3.2M for the weekend. It should pass $200M domestic by the end of the week. Meanwhile Green Book had even worse backlash when it was revealed that writer of the film Nick Vallelonga tweeted some insanely islamaphobic shit to Donald Trump back in 2015...oh and star of the film Mahershala Ali is a devout Mulsim. That also didn't seem to affect the already insanely embattled film which this weekend added 176 theater to make $2M for the weekend. A solid haul but no where near the kind of massive domestic gross (it still sits under $40M domestic) that usually comes with such a meh received movie getting such awards love. Oscar Movie Round-Up (cont.) - Meanwhile, If Beale Street Could Talk continues its good gradual expansion as its theater count passed 1,000 ending the weekend with $2.3M. The film seems to be finding a really good core audience and has not had the kind of drop-off usually associated with a challenging film like it expanding wide. What value that will have at all for Oscars will be seen. In the doc world Free Solo, one of the frontrunners for Best Documentary, had a limited IMAX run in 154 theaters this weekend which earned $812K. The film about the first ever attempt to free solo (aka without a rope) climb El Capitan has been pushed as a must see theatrical experience for inducing heart attacks in your enemies. This expansion could help Solo standout from the crowd but I still think people gonna vote for that Notorious RBG. Finally, speaking of Hurricane Glenn, the The Wife was rereleased in 156 theaters this weekend to try to capitalize on Glenn Close's emotional Golden Globes speech. However it seems while we all want Close to finally get her Oscar, people don't really care what the film is that gives it to her because the rerelease only scored $115K this weekend.
