The Department of Justice sided with xAI on Monday in a lawsuit filed by the NAACP alleging the AI company is violating the Clean Air Act by operating unpermitted natural gas turbines at its Colossus 2 data center in Southaven, Mississippi. In a memorandum filed Monday, the DOJ argued that shutting down the turbines would undermine “American national, economic, and energy security” and claimed the government would cut off power supply for AI innovation that supports the Department of Defense’s military operations. The DOJ requested the court dismiss the NAACP lawsuit, which was filed in April and seeks to halt operations at the site. The NAACP sued xAI and MZX Tech in April, citing Clean Air Act violations and alleging the companies were operating gas turbines without an air permit. The initial lawsuit cited 27 turbines without permits, but as of mid-May there are 57 turbines operating without permits at Colossus 2. In May the NAACP sought a preliminary injunction to halt turbine operations, claiming the unauthorized usage increases risks of asthma attacks and heart disease for nearby residents. The Southern Environmental Law Center, which is supporting the NAACP, says pollution measurements since April show a 111% rise in NOx, 83% rise in PM2.5, and 88% rise in formaldehyde since the turbines began operating. xAI claims the turbines are exempt from Mississippi air pollution regulations for one year because they are mounted on trailers and considered “mobile” generators. The Southern Environmental Law Center says federal law states trailer-mounted turbines can be considered stationary and subject to regulation. Residents living near xAI’s data centers in Memphis, Tennessee are furious about environmental concerns and broken promises about protection as SpaceX eyes a massive IPO, with the community calling for accountability regarding the company’s operation of polluting gas turbines and a water facility that was recently halted. Justin Pearson, a representative from Memphis in the Tennessee House, stated at one of the most highly polluted entities in the world, adding that people are going to die of this from the pollution. The xAI Colossus 1 campus gained national attention in 2024 when local residents raised concerns about the operation of natural gas turbines without the necessary permits. According to regulators, a loophole in the Clean Air Act allowed xAI to operate as many as 35 turbines without a permit a year, although a permit for 15 turbines has since been granted until 2027. These natural gas turbines release fine particulate matter known as PM2.5, which is associated with serious health problems such as heart attacks, high blood pressure, and increased mortality rates among individuals with preexisting conditions. The first data center was established in Bockcox, a Black neighborhood in Memphis that already faces some of the highest asthma rates in the nation due to past industrial pollution. Richard Massey, a community organizer in Memphis, expressed that everyone in South Memphis they know has a bronchial ailment or cancer and no place for their family to go, noting that everywhere Musk has gone it’s been the same result: people suffer, especially in marginalized low-income communities. My biggest ibs symptom is bloating and gas, sometimes it gets so bad it’s painful for days. Occasionally I get constipated and rarely get diarrhea. Does gas X help for anyone?? I take it and it doesn’t do much. Anyone have any other alternatives? I use Hilma gas and bloat (from target) and i don’t know if it helps to be honest.
